Maryland District Judge Deborah Boardman has ruled that ending birthright citizenship conflicts with long-standing U.S. law and tradition.

Trump’s attempt to deny automatic citizenship to children born to non-citizen parents has repeatedly faced judicial obstacles.

Judge Boardman’s recent decision emphasizes that the president’s order is at odds with the 14th Amendment, which ensures citizenship rights.

The executive order, originally set to take effect on February 19, demanded that automatic citizenship wouldn’t apply if neither parent held U.S. citizenship or permanent residency.

Despite its bold intent, legal experts argue the directive clashes with a century-old constitutional clause and Supreme Court precedents.

“All I have wanted is to focus on my baby being born healthy and safe, but instead, even though my baby will be born in the U.S., I have been worried that they will be denied a right is that guaranteed under the constitution — the right to be a U.S. citizen,” said Trinidad Garcia, a pregnant woman who is one of the plaintiffs, cited by NPR.

“This ruling will give mothers like me a bit of temporary relief as we navigate pregnancy and the uncertain future for our babies,” she added.

The legal proceedings reveal deeper tensions between protecting constitutional rights and addressing illegal immigration.

Many conservatives believe birthright citizenship encourages illegal immigration and tourism.

Yet Judge Boardman’s decision strengthens legal protections against any abrupt policy modifications that undermine established rights.

The Justice Department has not commented on the ruling.

However, the White House plans to appeal, arguing it’s essential to prioritize American interests.

As the legal battle continues, the nation awaits whether Trump’s policy aspirations or constitutional frameworks will prevail.

“The United States Supreme Court has resoundingly rejected the president’s interpretation of the Citizenship Clause of the 14th Amendment. In fact, no court in the country has ever endorsed the president’s interpretation. This court will not be the first,” said Judge Boardman, cited by The BBC.

The ongoing debate encapsulates the struggle between executive authority and constitutional fidelity, testing the judiciary’s resilience in preserving American values.

As the courts deliberate, citizens observe closely, mindful of the impact these rulings have on their constitutional liberties.

The hearing in Massachusetts is eagerly anticipated, promising to further scrutinize this controversial initiative and its potential implications for the nation’s foundational principles.
