Fox News first broke the news about a deposition Border Patrol Chief Raul Ortiz gave, which revealed that President Joe Biden’s border policies provided “no consequences” for the thousands of illegal immigrants traveling to the U.S.

Speaking under oath, Ortiz blamed the policies for a surge in illegal border crossings along the Southern Border.

Ortiz’s remarks were made on July 28 as part of discovery in a lawsuit by Florida Attorney General Ashley Moody. Moody filed a suit against the Department of Homeland Security and other border agencies, charging them with breaking established federal law — the Immigration and Nationality Act — under Biden’s instruction.
The law requires officials to detain illegal immigrants at the border until they can be returned to their country of citizenship.

In his deposition, the Border Patrol Chief, with 31 years of law enforcement experience, expressed that migration would increase exponentially at the Southern border due to a lack of “consequences.”

“In my experience, we have seen increases when there are no consequences,” Ortiz said.

An attorney representing Florida queried whether “migrant populations believe that… there are not going to be consequences, more of them will come to the border. Is that what you’re saying?”

Ortiz replied, stating: “There is an assumption that if migrant populations are told that there is a potential that they may be released, that, yes, you can see increases.”

The attorney sought clarification with a follow-up question: “So, it will increase at an exponential rate. Is that what is being suggested here?”

Ortiz gave a measured response, saying, “Well, I do think it will increase, yeah.”

An attorney then pointed to a Spring 2021 memo by Biden, asking whether the “document indicate that aliens illegally entering the United States perceive that they will be able to enter and remain in the United States?”

“Yes,” Ortiz replied.
